1. Acceptance of Terms

These terms form an agreement between 9381-9506 Québec Inc., operating as VOSKER, and users of the VOSKER website, web app, mobile application, services, software, applications, and subscriptions. By using the platform or services, you accept the Terms of Use. If you do not accept them, you must not use the platform.

The platform is available only to users who can legally enter into binding contracts. By using it, you confirm that you are at least eighteen years old and are not prohibited from using the platform or services under applicable law.

2. Changes to the Terms

VOSKER may modify or update the Terms of Use from time to time. Unless changes are made for legal or administrative reasons or are not material, VOSKER will provide reasonable notice before amended terms become effective. Continued use of the platform after the effective date means you accept the amended terms.

3. Use of the Platform

The platform allows users to purchase VOSKER products and services such as security cameras, accessories, and cellular transmission plans. Depending on the camera model, the web and mobile apps may also allow users to activate cameras, locate GPS position, manage devices, and view photos captured by the camera.

VOSKER grants users a limited, non-exclusive, non-transferable right to access and use the platform for lawful purposes only. Users may not scrape, copy, distribute, interfere with, overload, compromise, reverse engineer, transmit spam or malicious code, impersonate others, harvest information, bypass restrictions, access content through unauthorized means, or otherwise use the platform in violation of applicable law.

4. Electronic Communications

When you provide an email address through the platform, you consent to VOSKER using it to communicate with you about account validation, account status, surveys, platform functionality, promotions, security, and other platform-related matters. You may unsubscribe from newsletters where applicable.

5. Accounts and Security

Certain features require a user account. You agree to provide true, complete, and updated information and to choose a secure password. You are responsible for maintaining the confidentiality of your username and password and for all activity under your account. You must notify VOSKER immediately of unauthorized activity or security breaches.

VOSKER may terminate your right to use the platform for inaccurate account information or breaches of the terms. VOSKER may delete accounts inactive for at least one year after prior notice. You may suspend or terminate your account at your discretion.

6. Fees, Purchases, Billing, and Delivery

VOSKER may charge fees for access to the platform, but fees will not be charged without prior consent and will be displayed prominently. Users must pay charges billed to their account at the applicable rate and must pay applicable taxes.

Commercial customers must submit purchase orders using VOSKER’s standard form. Consumers may place orders online. VOSKER may accept, reject, or propose changes to purchase orders. Prices, payment, invoices, receipts, delivery methods, shipping addresses, and delivery estimates are governed by the terms shown at purchase. Delivery times are estimates, and VOSKER is not responsible for delivery delays. Risk of loss passes after goods are delivered.

7. Consumer Rights, Returns, Refunds, and Exchanges

Certain provisions apply only to consumers. Consumer distance contracts must be provided in writing and may be cancelled in specified circumstances under applicable consumer protection rules. If VOSKER fails to refund amounts when required and payment was made by credit card, consumers may have chargeback rights within the applicable period.

VOSKER generally does not offer refunds except where required for consumers under the terms. Exchanges may be requested within thirty days of purchase for a product of the same or greater value, subject to conditions. Products must be unused and in the same condition received. Returns require proof of purchase and a Return Merchandise Authorization number. Shipping and handling charges are non-refundable, and VOSKER may refuse returns based on product condition.

8. Products, Services, and Warranty

VOSKER attempts to display product colors and images accurately but does not guarantee exact display or appearance. Product and service prices, descriptions, availability, and quantities may change without notice. VOSKER may modify, suspend, discontinue, limit, or restrict products or services at any time where permitted by law.

VOSKER provides a two-year warranty on cameras and other transmission devices sold, and a one-year warranty on other products including accessories, subject to product documentation and diagnosis. No warranty is provided for products with physical damage.

9. Intellectual Property and Feedback

VOSKER trademarks, logos, original works, platform content, designs, patents, documentation, and other intellectual property remain the property of VOSKER or its rights holders. Users may not use, reproduce, imitate, copy, or distribute platform content except as permitted by the terms. VOSKER may use, publish, keep secret, or otherwise exploit feedback, ideas, and suggestions without compensation or attribution.

10. User Content

You retain ownership of images, text, graphics, videos, photos, information, and other materials you upload to the platform. By submitting content, you grant VOSKER a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use that content for commercial and legal purposes and as necessary to provide services, improve services, or comply with legal obligations, subject to VOSKER’s Privacy Policy.

You are solely responsible for your content and must have all rights needed to submit it. You agree to defend and indemnify VOSKER and its affiliates against claims arising from prohibited, illegal, infringing, or unauthorized content.

11. Confidential Information and Third-Party Links

Users must keep VOSKER confidential information confidential and may use it only for permitted platform use. The platform may contain links to external websites. VOSKER is not responsible for their availability, accuracy, content, products, or services, and links do not imply endorsement. Users assume all risks from using external sites.

12. No Warranty and Limitation of Liability

The platform is provided “as is” without warranty of any kind to the fullest extent permitted by law. VOSKER disclaims warranties including merchantability, fitness for a particular purpose, non-infringement, accuracy, freedom from error, content accuracy, availability, and quality of products, services, or content obtained through the platform.

Users assume all risks from accessing or using the platform, services, and products. VOSKER’s liability for direct damages is limited as described in the current terms, and VOSKER and its affiliates are not liable for indirect, special, incidental, consequential, loss-of-use, loss-of-data, or loss-of-profit damages to the fullest extent permitted by law.
